Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to TAP (com.neverhold.tap), Neverhold dialer (com.neverhold.dialer), and related neverhold.co services that share the same account, to the extent the features below exist in each app.
App-specific Terms of Service (this AUP supplements them): TAP Terms · Neverhold Terms · all Terms. Privacy: TAP Privacy · Neverhold Privacy · all Privacy.
If this AUP conflicts with the Terms on a specific prohibition, the stricter rule controls for enforcement until the Terms are updated to match.
1. Purpose
Neverhold products help people exchange contact cards, manage calls, and optionally share emergency information they control. This AUP sets rules so those features are not used to harass, impersonate, spam, spoof caller identity, abuse emergency tools, or target children.
2. Accounts and identity
You must:
- Provide accurate account information you are authorized to use.
- Keep credentials secure and not share accounts in a way that enables abuse.
- Not create or operate accounts primarily to evade suspensions, rate limits, or prior bans.
You must not:
- Impersonate any person, business, public figure, or Neverhold.
- Misrepresent your affiliation with any person or organization.
- Use another person’s name, photo, brand, or contact details on a TAP / Æther card, profile, Business card, or outbound identity display without that person’s permission (or other lawful basis).
3. Display names, usernames, and caller ID (including Twilio)
Where the Services let you set a username, display name, or similar label that may appear to others — including as caller ID / CNAM-style presentation via Twilio or other telephony providers — you agree that:
- The label is a presentation you control; it is not proof of identity and must not be used to deceive.
- You will not choose names that impersonate others, mimic emergency services, banks, government agencies, Neverhold staff, or known brands in a misleading way.
- You will not use caller-ID / username presentation to spoof, commit fraud, phish, social-engineer, or harass.
- You will not rotate names or numbers to evade blocks, spam filters, or prior reports.
- Verified phone numbers (where required) remain subject to ownership/authorization rules in the Terms; a username shown as caller ID does not replace number verification or grant rights you do not have.
We may require changes to display names, suspend calling or messaging features, or terminate accounts when we reasonably believe this section is violated.
4. TAP / Æther cards, proximity and remote share, field chooser
TAP lets you choose which fields to include each time you share (“field chooser”). You may limit fields for privacy or safety. Public docs describe this as choosing which fields to share.
You must not:
- Use TAP share (proximity, remote, attachment, or any future share path) to harass, stalk, intimidate, or coerce anyone.
- Share another person’s personal data, photos, or card content through TAP without that person’s consent (or other lawful basis), including contacts you imported or synced.
- Reconstruct or push cards in a way intended to dox, shame, or publicly expose someone against their will.
- Spam share requests, repeatedly force proximity/remote exchange after refusal, or use TAP log / meeting history to contact people who asked you to stop.
- Circumvent field chooser, privacy settings, or share confirmations.
You are responsible for what you put on cards you send and for respecting recipients’ choices about what they accept or delete.
5. TAP Rescue Card (formerly Medical ID), emergency share, lock-screen, NFC
TAP Rescue Card is an optional personal safety / ICE-style profile.
Accurate claims:
- Not a medical device; not FDA-cleared/approved as one (unless that status later changes and docs are updated).
- Not dispatch, not a substitute for 911 / local emergency services, EMS, or professional medical care.
- “Rescue” describes a user-controlled emergency profile and contact alert — not a monitored rescue service, SAR team, or guaranteed response.
- Delivery of SMS, NFC, nearby radios, lock-screen flows, and in-app Message Center copies is not guaranteed.
- You are responsible for accuracy of fields and for keeping designated emergency contacts current and authorized.
You must not:
- Use TAP Rescue Card, lock-screen Send, emergency SMS, NFC rescue/medical share, or rescue
.tapcardfor pranks, harassment, marketing, testing on people who did not consent, or contacting anyone other than contacts designated on a Rescue Card you lawfully control. - Enter another person’s health information except as that person (or their lawful representative) authorized.
- Impersonate an injured person, first responder, hospital, or emergency service.
- Market or present TAP Rescue Card as a medical device, 911 replacement, or guaranteed life-saving / monitored rescue system.
6. Business Account, CRM, and follow-ups
If you use Business Account, extra business cards, catalogs/offers, mailbox sync, or CRM-style follow-ups:
- Follow applicable anti-spam and telemarketing laws (including TCPA, CAN-SPAM, CASL, and local rules where you operate).
- Only message people you have a lawful basis to contact; honor opt-outs and “do not contact” requests promptly.
- Do not use synced contacts, TAP log, or emergency tools to build unsolicited bulk outreach lists.
- Do not run automated or high-volume messaging through Neverhold/TAP features in ways that resemble spam or abuse of Twilio/carrier networks.
7. Children and age
- Eligibility (Terms): You must be at least 18 (or the age of majority in your jurisdiction, whichever is higher).
- Privacy: The Services are not directed at children under 13 (or 16 in the EEA where a higher age applies).
- Do not create accounts for anyone under 18 (or majority), or use the Services to collect personal information from children.
- Do not use TAP, cards, caller ID, TAP Rescue Card, or emergency features to target, groom, exploit, or market to children.
8. Prohibited technical and security abuse
You must not:
- Scrape, crawl, or bulk-export the Services, other users’ cards, or directories without our express written permission.
- Reverse engineer to extract secrets, keys, non-public APIs, or bypass security (except to the limited extent mandatory law allows interoperability and you provide any required notice).
- Probe, scan, or attack infrastructure; introduce malware; or interfere with other users’ use.
- Bypass rate limits, auth, billing, entitlement checks, or abuse reporting systems.
9. Illegal content and general unlawful use
You must not use the Services for fraud, phishing, identity theft, unlawful surveillance, threats, or any other illegal purpose. Content and conduct that is abusive, defamatory, or otherwise unlawful under applicable law is prohibited.
10. Enforcement
We may investigate reports, remove or restrict content/features, require identity or name changes, suspend VoIP/SMS/share/TAP Rescue Card features, or terminate accounts. We may report illegal activity to authorities or carriers/providers (including Twilio) when appropriate. Enforcement choices do not waive our right to act later.
11. Reporting
Report abuse or AUP concerns to [email protected] (and [email protected] for privacy incidents). Do not use emergency SMS / TAP Rescue Card channels to report product abuse.
12. Changes
We may update this AUP. Material changes should follow the same notice pattern as the Terms (in-app / site / email as applicable). Continued use after the effective date means you accept the updated AUP.
